This Privacy Policy explains how G-Fenix processes the personal data you share with us through this website — in particular through the contact form, the “Have a project in mind?” email form and the G-Chat assistant — in accordance with the EU General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD).

1. Data Controller

We have not appointed a Data Protection Officer because it is not mandatory for our activity. For any privacy question, write to hello@g-fenix.com.

2. What Data We Process and Why

2.1 Contact form

• Data: First name, last name, email address, subject and message.
• Purpose: To answer your enquiry, send you an automatic confirmation email and, if you ask for it, prepare a proposal.
• Legal basis: Your consent, given by ticking the box on the form, and the application of pre-contractual measures at your request (Art. 6(1)(a) and (b) GDPR).
• Retention: Until your enquiry has been handled and, after that, for up to 2 years, unless a business relationship follows or you ask us to delete it earlier.

2.2 “Have a project in mind?” form

• Data: Email address and, if you tick the optional box, your consent to receive news and offers.
• Purpose: To contact you about your project and send you an automatic confirmation email. Only if you also tick the optional box will we send you occasional news and offers about our services; you can unsubscribe at any time by replying to any of our emails or writing to hello@g-fenix.com.
• Legal basis: Your consent (Art. 6(1)(a) GDPR and Art. 21 LSSI-CE). You can withdraw it at any time.
• Retention: Until you withdraw your consent or ask us to stop contacting you.

2.3 G-Chat (AI assistant)

• Data: The messages you type into the chat and the language of the page.
• Purpose: To generate an automatic answer to your question. Messages are sent to our AI provider (Anthropic) to produce the reply. G-Fenix does not store chat conversations.
• Legal basis: Our legitimate interest in answering the questions you choose to ask us (Art. 6(1)(f) GDPR).
• Retention: Not stored by G-Fenix. The AI provider may keep the data for a limited period under its commercial terms, which do not allow it to use the data to train its models.

Please do not share personal, confidential or sensitive information in the chat.

2.4 Email, phone, WhatsApp and Telegram

• Data: Your name, contact details and the content of your messages.
• Purpose: To reply to you and, where applicable, manage the services you contract with us.
• Legal basis: Your request and, if you become a client, the performance of the contract (Art. 6(1)(b) GDPR).
• Retention: As long as needed to handle your request and, for clients, for the periods required by tax and commercial law.

2.5 Technical data

• Data: IP address, browser and device type, pages requested and date and time of access, recorded in server logs.
• Purpose: To run the website, prevent abuse and keep it secure.
• Legal basis: Our legitimate interest in the security and proper operation of the website (Art. 6(1)(f) GDPR).
• Retention: For a limited period, normally no longer than 90 days.

Providing your data is voluntary, but the fields marked as required are needed to handle your request. We do not make automated decisions or create profiles that produce legal effects on you.

3. Who Receives Your Data

We do not sell your personal data or share it with third parties. To run the website we use the following service providers, which process data only on our behalf and following our instructions (data processors), under agreements that comply with the GDPR:

• Render — hosting of the website and its database.
• IONOS — email service (sending and receiving emails).
• Anthropic — AI model that powers G-Chat; it only receives the messages typed into the chat.
• Google Maps — map on the Contact page; it is only loaded with your consent.
• Google Fonts, cdnjs (Cloudflare), jsDelivr, unpkg — content delivery networks that serve fonts, icons and scripts; they technically receive your IP address when your browser loads these files.

We may also disclose your data to public authorities, judges and courts when we are legally obliged to do so.

4. International Transfers

Some of these providers (such as Render, Anthropic, Google and Cloudflare) are based in, or may process data in, the United States. In those cases transfers are covered by the EU–U.S. Data Privacy Framework when the provider is certified under it, or by the Standard Contractual Clauses approved by the European Commission (Art. 46 GDPR).

5. Your Rights

You can exercise the following rights at any time, free of charge:

• Access — find out whether we process your data and obtain a copy.
• Rectification — correct inaccurate or incomplete data.
• Erasure — ask us to delete your data.
• Restriction — ask us to limit how we use your data.
• Objection — object to processing based on our legitimate interest.
• Portability — receive your data in a structured, machine-readable format.
• Withdrawal of consent — at any time, without affecting the lawfulness of processing carried out before.

To exercise them, email hello@g-fenix.com with the subject “Data protection”, stating which right you want to exercise. We may ask you for additional information to verify your identity. We will reply within one month.

If you believe your rights have not been respected, you can file a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es.

6. Minors

Our services are aimed at businesses and adults. We do not knowingly collect data from children under 14. If you are under 14, please do not send us your personal data.

7. Security

We apply appropriate technical and organisational measures to protect your data: all traffic is encrypted with HTTPS (TLS), access to stored messages is restricted to authorised team members, and our providers apply their own security safeguards.

8. Cookies

We only use technical cookies that are necessary for the website to work. The Google map on the Contact page, which sets Google cookies, is only loaded if you accept it in the cookie banner. You can find all the details in our Cookie Policy.

9. Changes to This Policy

We may update this policy to reflect legal or technical changes. We will publish any new version on this page with its update date and, if the changes are significant, we will let you know through a notice on the website.
