Terms of Service
Last updated: 13 October 2026
1. About These Terms
These Terms of Service govern the use of the website g-fenix.com (the “Website”) and the general conditions of the services offered by G-Fenix (identified in the Legal Notice). By using the Website you accept these Terms. If you do not agree with them, please do not use the Website.
2. Our Services
G-Fenix offers web development, QR menu and digital card solutions, AI chatbots and agents, data consultancy, training, and automation services. The descriptions, examples, timelines and prices shown on the Website are for information only and do not constitute a binding offer.
3. Proposals and Contracts
Each project is governed by a written proposal or contract that sets out its scope, deliverables, timeline, price and payment schedule. The project starts once the client has accepted the proposal in writing (email is enough). If a proposal or contract conflicts with these Terms, the proposal or contract prevails.
4. Prices and Payment
Prices are quoted in euros and, unless stated otherwise, do not include VAT. Payments are usually made in instalments linked to project milestones, as set out in each proposal. The number of revision rounds included is specified in the proposal; additional work or changes in scope are quoted separately.
5. Client Responsibilities
The client agrees to provide accurate information and, on time, the content, access and feedback needed for the project, and guarantees that it holds the rights to any material it provides (texts, images, logos, data). Delays in providing them may extend the agreed timeline.
6. Intellectual Property
The content of the Website (texts, design, graphics, logos and code) belongs to G-Fenix or its licensors and may not be reproduced without our prior written consent.
Unless otherwise agreed in writing, once a project has been paid in full the client owns its content, domain, data and the code developed specifically for it. G-Fenix keeps ownership of its pre-existing tools, components and know-how, and grants the client a licence to use them as part of the delivered project. Open-source components remain subject to their own licences.
We may mention completed projects in our portfolio unless the client objects in writing.
7. Acceptable Use of the Website
When using the Website you agree not to:
- use it for unlawful purposes or in a way that harms G-Fenix or third parties;
- try to access systems or data without authorisation, or introduce viruses or malicious code;
- copy content automatically (scraping) or overload the Website;
- send false data, spam or messages that are not genuine enquiries through the forms or the chat.
8. G-Chat AI Assistant
G-Chat answers automatically using artificial intelligence. Its answers may be inaccurate or incomplete and are not professional advice or a binding offer: prices, deadlines and commitments are only valid when included in a written proposal. Please do not share personal, confidential or sensitive information in the chat.
9. Liability
The Website is provided “as is”. To the extent permitted by law, G-Fenix is not liable for indirect or consequential damages arising from the use of the Website or reliance on its content. Liability related to client projects is governed by the corresponding proposal or contract. Nothing in these Terms limits liability that cannot be limited by law, such as liability for wilful misconduct or gross negligence.
10. Consumers
If you contract our services as a consumer, you keep all the rights granted to you by consumer protection law, including, where applicable, the right to withdraw from a distance contract within 14 days (Spanish Royal Legislative Decree 1/2007). If you ask us to start the work during that period and then withdraw, you will have to pay for the part of the service already provided.
11. Third-Party Links
The website may contain links to third-party websites. We are not responsible for their content or privacy practices.
12. Governing Law and Jurisdiction
These Terms are governed by Spanish law. Any dispute will be submitted to the courts of Barcelona, except where you are a consumer, in which case you may go to the courts of your place of residence.
13. Changes to These Terms
We may update these Terms. The version published on this page, with its update date, is the one that applies. Changes do not affect projects already agreed, which remain governed by their own proposal or contract.
